my daughter lost her apartment while she was nine months pregnant. She moved in with friends and the day my grandson was born. Her friend kicked her out the house. I told her she can come and live with me for six months without paying me any rent so that she can have money to find her own place. May 2024 made six months, it is now October 30 and she is still here. I told her she have to find somewhere else to live and she told me I can’t make her leave because she’s been living there for more than six months and receive mail at my address. How can I get her out of my house?

Unfortunately, if you don’t have a written or oral lease, the case is not an eviction and is outside our practice areas.

Is it legal to have a tenant sign an agreement they will never be late again, and if they are, the eviction will continue where if left off ?
It really depends on the facts of the case, i.e. whether there is a stipulation for settlement that the court will enforce after closing the case. The Court would have to order this arragement.
Can you use a case number that has already been deposed or by a judge for a different case? In this case it would be an eviction. I was evicted by my mother in 2013 and it was already closed by a judge. Now I’m in the situation and I was served with an eviction notice today and I happened to notice old case number of 2013. Is this binding?
No, you can not use an old case number on a new matter.
